USDA will allow its Single Family Housing Guaranteed Loan Program to finance homes with income-producing accessory dwelling units starting Dec. 28, 2026. The change expands eligible rural housing options, but potential rent from an ADU will not help applicants meet the program’s qualifying income ratios.
The Rural Housing Service published the final rule Oct. 29. The program provides loan guarantees to help low- and moderate-income people in rural areas buy homes. The publication date does not start the new eligibility provisions, which take effect in December.
Rental units become eligible
The rule permits guarantees for properties with one or multiple income-producing ADUs. These smaller residences can be inside a primary home, attached to it or in a separate building on the same property. USDA describes conversions of attics and basements, units above garages and standalone dwellings as possible configurations.
In its March 31 proposal, the agency explained that existing rules prohibited financing properties with income-producing buildings such as freestanding rental ADUs. Units that did not generate income, including those supporting multigenerational households, were already allowed. The final rule retains eligibility for non-income-producing ADUs.
Potential rent does not count toward qualification
Property eligibility and borrower qualification remain separate questions. USDA says lenders cannot use income in an applicant’s qualifying ratios when its source cannot be verified, it is unstable or it is unlikely to continue. The agency places potential ADU income in that category and excludes it from those calculations.
USDA also retains the requirement that financed properties remain primarily residential. The rule does not remove the prohibition on purchasing or improving property principally used to produce income.
A related clarification allows properties accommodating home-based operations with noncommercial real estate features. USDA adopted the March proposal without changes, combining that clarification with the expanded ADU eligibility.
